Ruby 1.9.3將改用 BSD 許可證發(fā)布
Ruby 從下一個(gè)版本，也就是 1.9.3 開始，從原先的 GPLv2 許可證換成了 2-clause BSD 許可證(大體上相當(dāng)于 MIT 許可證)。
早期 Ruby 采用的是自由軟件基金會(huì)推薦的 GPLv2 or later 許可證方式。在實(shí)際操作中這種許可方式十分常見，這種許可證方式包含兩層意思：
- 軟件本身以 GPLv2 許可證發(fā)布
- 當(dāng)自由軟件基金會(huì)修訂 GPL 并發(fā)布新版 GPL 時(shí)，授權(quán)一方同意受權(quán)人以新的 GPL 條款來(lái)發(fā)布軟件 (*)
這其中 (*) 的部分實(shí)際上是開給自由軟件基金會(huì)的一張空白支票，并且可能導(dǎo)致各式各樣的法律問題。據(jù)我個(gè)人的了解，灣區(qū)企業(yè)的法務(wù)部門通常不允許公司以這種方式發(fā)布軟件，因而，商業(yè)公司在使用 GPLv2 or later 許可證的軟件時(shí)，通常會(huì)在發(fā)布代碼的同時(shí)明確說(shuō)明自己在使用這個(gè)軟件時(shí)只遵循某個(gè)特定版本的GPL，以規(guī)避潛在的法律風(fēng)險(xiǎn)：

然而，實(shí)際上這樣使用代碼也是有風(fēng)險(xiǎn)的。例如，如此這家廠商便無(wú)法同時(shí)使用 GPLv3 許可證的代碼。因?yàn)镚PLv2 中規(guī)定：
4. You may not copy, modify, sublicense, or distribute the Program except as expressly provided under this License. Any attempt otherwise to copy, modify,sublicense or distribute the Program is void, and will automatically terminate your rights under this License. However, parties who have received copies, or rights, from you under this License will not have their licenses terminated so long as such parties remain in full compliance.
同時(shí)，GPLv2 中也規(guī)定：
6. Each time you redistribute the Program (or any work based on the Program), the recipient automatically receives a license from the original licensor to copy,distribute or modify the Program subject to these terms and conditions. You may not impose any further restrictions on the recipients' exercise of the rights granted herein. You are not responsible for enforcing compliance by third parties to this License.
簡(jiǎn)而言之， GPLv2 only 的代碼和 GPLv3 許可證的代碼是不能一起 redistribute 的，原因是 GPLv3 中增加了包含對(duì)硬件和軟件專利等問題而增加的一系列限制自由的條款(違反第6條)，而另一方面，自由軟件基金會(huì)又認(rèn)為 Ruby License 是非自由軟件授權(quán)，因此，GPLv3 許可證的軟件又不能與 Ruby 以 Ruby License 聯(lián)編，因?yàn)檫@樣做違反 GPLv3 第10條的內(nèi)容：
10. Automatic Licensing of Downstream Recipients.
[...]
You may not impose any further restrictions on the exercise of the rights granted or affirmed under this License. For example, you may not impose a license fee,royalty, or other charge for exercise of rights granted under this License, and you may not initiate litigation (including a cross-claim or counterclaim in a lawsuit) alleging that any patent claim is infringed by making, using, selling, offering for sale, or importing the Program or any portion of it.
由于 Ruby 只以兩種許可證之一發(fā)布，因此，發(fā)布聯(lián)編的可執(zhí)行文件要么違反 GPLv2，要么違反 GPLv3，因此再發(fā)布的結(jié)果只能以源代碼的形式提供，而不允許再發(fā)布其二進(jìn)制文件。
自由軟件基金會(huì)從 6.0 版開始，將 readline 庫(kù)改為 GPLv3 or later，這樣一來(lái)，GPLv2 only 的 Ruby 便不能發(fā)布聯(lián)入了 readline 的可執(zhí)行文件了。
為了因應(yīng)自由軟件基金會(huì)改換授權(quán)可能給最終用戶帶來(lái)的困擾，去年 9 月，Ruby Changeset r29262 將 Ruby 中的 GPLv2 許可證完全刪除，并改換為基于 FreeBSD 許可證的 2-clause BSD 許可證，從而賦予了用戶選擇的權(quán)利。
感謝 Richard Stallman 和自由軟件基金會(huì)使更多的人選擇了 BSD 許可證。
